<p class="MsoNormal">Emotional Support animals or Therapy dogs are NOT service animals under the ADA . Libraries can implement their own policies for these animals in compliance with applicable building and health codes.<o:p></o:p></p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">Libraries ( or any other establishment) may ask a patron with a service animal two questions:<o:p></o:p></p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">Is the animal a service animal required because of a disability?<o:p></o:p></p>
<p class="MsoNormal">What work or task has the animal been individually trained to perform?<o:p></o:p></p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">If the person refuses to answer, access can be denied to the animal, but service would have to be provided to the person without the animal present.<o:p></o:p></p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">In addition, service animals must be under the control of their handler at all times. Aggressive behavior or behavior that demonstrates that the animal is not under the control of the handler can result in the animal being removed or excluded.<o:p></o:p></p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">If the animal has an accident, the owner or handler is responsible for cleaning the mess.<o:p></o:p></p>
<p class="MsoNormal"><o:p> </o:p></p>
<p class="MsoNormal">As with all policies, have the library’s attorney review any service animal policy before implementation to ensure that it complies with applicable state and Federal law.<o:p></o:p></p>
